Open Mic Jam Waiver
I hereby grant Second Street Music and its representatives, employees, and agents (hereinafter referred to as "the Organization"), the right and permission to use, reproduce, distribute, stream, and publicly display any photographs, videos, or audio recordings taken of me during the Tuesday Night Jam Session Open Mic (hereinafter referred to as "the Event”).
I understand and agree to the following terms and conditions:
Consent: I consent to Second Street Music capturing, recording, and using photographs, videos, and audio recordings of me during the Event for any lawful purpose, including but not limited to promotional materials, marketing campaigns, websites, social media platforms, and publications.
Ownership: I acknowledge and agree that Second Street Music does not claim ownership of the underlying composition copyright for original music performed at the Event. By signing this waiver, I grant Second Street Music a non-exclusive license to use the recordings containing my performance for any lawful purpose, including but not limited to promotional materials, marketing campaigns, websites, social media platforms, and publications.
Copyright of New Original Music: In the event that new original music is created during the Event through collaborative efforts among participants, the copyright rights to such new original music shall be evenly split among all participants who actively contributed to its creation. Participants agree to grant Second Street Music a non-exclusive license to act as the music publisher for the new original music, including the right to register copyrights, administer publishing rights, and collect royalties on behalf of all participants involved. Second Street Music shall not claim sole ownership or any exclusive rights to such new original music without the explicit consent and agreement of all participants involved.
Release of Liability and Indemnification: I release Second Street Music, its employees, and agents from any claims, liabilities, or damages arising from my participation in activities, including personal injury, illness, or property damage. I also agree to indemnify Second Street Music against any claims related to my actions during these activities.
Assumption of Risk: I am aware of and willingly assume all risks associated with participating in any activities at Second Street Music, acknowledging the possibility of physical injury, illness, or property damage.
No Compensation: I acknowledge that I will not receive financial compensation for my participation in activities or the use of media that includes my image or performances.
Confidentiality and Media Sharing: I understand that Second Street Music may share these media with third parties, and these parties may further use and distribute them.
Privacy: Second Street Music will not sell your personal information.
I have carefully read this Release and Waiver of Liability, fully understand its contents, and voluntarily agree to its terms and conditions.
